Baked Earth — Terms & Conditions
1. Definitions

“Company”, “Seller”, “we”, “us”, “our”: Baked Earth.

“Buyer”, “Customer”, “you”, “your”: The person or entity purchasing Goods from the Seller.

“Goods”: Tiles and any other products offered for sale by the Seller.

“Stock Items”: Products identified on our website as standard items in stock.

“Non‑Stock Items” / “Special Products”: Products identified on our website as non‑standard or out of stock, or made to order.

“Order” / “Contract”: The contract between the Buyer and the Seller for the sale and purchase of Goods.

“Price”: The price of the Goods, exclusive of VAT and (where applicable) delivery, packaging and insurance unless expressly stated otherwise.

“In Writing”: Communication by postal letter, email, facsimile or comparable means.
Headings are for convenience only and do not affect interpretation.
2. Basis of Contract
2.1 Each Contract comprises (a) your Order, (b) these Terms & Conditions, and (c) any specific terms agreed in writing. If there is any conflict, the specific terms take priority, then these Terms & Conditions.
2.2 Our catalogues, price lists, website and advertising are invitations to treat only and do not form part of the Contract. Product descriptions and information are believed accurate but are supplied by manufacturers; we do not warrant their accuracy.
2.3 By placing an Order you confirm you have checked quantities, measurements and suitability for your intended use. Tile coverage figures per m²/yd² are nominal; allow for wastage and cuts.
3. Pricing & Quotations
3.1 Unless stated otherwise in writing, all Prices are exclusive of VAT.
3.2 Quotations are valid for 30 days from issue, unless withdrawn earlier.
3.3 We work to keep website pricing accurate; errors may occur. If a pricing error is discovered after you place an Order, we will contact you to reconfirm at the correct price or cancel and refund. If we cannot reach you, we will cancel and refund any payment for Stock Items.
3.4 Prices may change without notice prior to our acceptance of your Order.
3.5 Only one promotional code or e‑voucher may be used per transaction. Promotional codes cannot be used with pallet deals, job lots, delivery‑only vouchers, or in conjunction with our Price Promise.
4. Payment
4.1 We accept PayPal and most major debit/credit cards via our online checkout, processed by accredited third‑party payment providers. We are not responsible for any non‑authorisation or delays caused by payment providers or additional fraud checks.
4.2 Cardholder/Buyer identity verification may be required. We may conduct further checks and are not liable for delays or costs arising from such checks.
4.3 Payment authorisation is required before dispatch. Payment for Goods constitutes acceptance of these Terms & Conditions.
4.4 We reserve the right to refuse to supply any Buyer at our sole discretion (without prejudice to accrued rights or remedies).
5. Price Promise
5.1 We aim to beat any UK tile retailer’s like‑for‑like price by 10%. Conditions:

Products must be identical, new, first choice and in stock (or on pre‑order within 8 weeks).

Competing offer must be from a UK VAT‑registered retailer and not bankrupt stock, auction, end‑of‑line, clearance or damaged goods.

Written proof (e.g., quotation or URL screenshot) is required.
-
Not available in conjunction with other offers or for pallet deals/job lots.
We may verify stock and price; a decision will be made at our discretion.
6. Product Quality & Warranty
6.1 Suitability: Supply does not imply suitability for a specific installation. You are responsible for verifying that the Goods meet your performance requirements (including slip resistance, frost resistance and technical data) before installation. Samples are recommended.
6.2 Natural & Handmade Products: Natural stone and handmade terracotta vary in colour, tone, size, surface texture and pattern. Manufacturing tolerances may include small chips, wax odour and surface marks. Terracotta is handmade/wood‑fired; variation of approx. 3–12 mm in size and density/texture is normal.
6.3 Installation Guidance: We do not provide installation services. Any guidance on our website is for general information only; obtain independent technical advice suitable to your project. Terracotta should be installed on a solid/concrete base.
6.4 Blending: For significant areas, mix tiles from multiple boxes to minimise shade/batch variation.
6.5 Manufacturer Responsibility: Any fault, quality or shading issues remain the manufacturer’s responsibility. Our liability is limited to replacement of defective Goods or (at our discretion) a refund for the affected Goods; we are not liable for consequential loss including labour or fitting costs.
6.6 Claims: Notify us in writing within 5 working days of delivery of any defect, non‑conformity or shortage. If delivery is refused and we are not notified, you remain liable for the Price. Valid claims entitle you to replacement of affected Goods or refund of the corresponding Price; no further liability applies.
6.7 Cleaning & Maintenance Products: Always read manufacturer instructions and test on a small area first. We accept no liability for misuse.
7. Delivery & Risk
7.1 Delivery services include Standard (typically 2–4 working days) and Express (typically 2 working days). Orders placed after 2pm Friday are processed the following Monday. Time is not of the essence.
7.2 Kerbside Delivery: Deliveries are kerbside only. Drivers are not insured to enter private property. Hazards/obstructions (steps, gravel, narrow access, height/width limits, etc.) may require delivery to the nearest safe point. Please ensure suitable access for a large vehicle (comparable to a fire engine or larger). If a smaller/specialist vehicle is required, additional charges may apply.
7.3 Attendance: You (or your representative) should be present to sign and inspect on delivery. If delivered without a signature, you are responsible for inspection.
7.4 Damage in Transit: Do not accept visibly damaged consignments unless authorised by us in writing. Report concealed damage or shortages within 2 working days of delivery with photos; keep packaging.
7.5 Handling After Delivery: After delivery, remove boxes from pallets and stack vertically (not flat). Damage arising from improper storage/stacking is at your risk.
7.6 Risk & Title: Risk passes on physical delivery. Title passes upon receipt of cleared funds in full.
7.7 Scheduling Trades: Do not book tilers or trades until Goods are delivered, checked and accepted. We are not liable for costs of missed appointments or delays beyond our reasonable control (see Force Majeure).
8. Cancellations & Returns
Your statutory rights differ for consumers and business customers. The below commercial policy applies alongside your legal rights.
8.1 Consumer right to cancel (distance/off‑premises)
If you are a consumer buying online/phone/mail order, you have a 14‑day cooling‑off period from delivery to cancel without giving a reason. You must take reasonable care of the Goods and return them to us without undue delay and within 14 days of cancellation. We will refund the Goods’ price and the standard delivery charge (not enhanced delivery), less any permitted deductions for diminished value due to handling beyond what is necessary to inspect the Goods. You bear the cost of return unless we agree otherwise.
Note: Per law, bespoke/made‑to‑order items and certain sealed goods may be excluded from the right to cancel; we will advise where applicable.
8.2 Commercial goodwill (all customers)
Separate from statutory rights, we offer the following goodwill policy:

Change of Choice / Surplus: You may return unopened cartons in resaleable condition within 30 days of delivery. You are responsible for arranging insured return to our distribution warehouse (LS12 6AL) by pallet service. A 20% restocking fee applies to cover inspection and re‑packing. Original delivery charges are non‑refundable.

Damages/Incorrect Supply: Notify us within 2 working days of delivery. We will arrange replacements as quickly as possible or refund the Goods’ price (original delivery charges are not refunded under this goodwill policy). Damaged tiles must be retained for inspection or return as directed.
Important: Extra boxes sent in error or as a goodwill allowance to cover wastage are not eligible for refund.
8.3 Non‑Stock / Special Products
Orders for Non‑Stock or made‑to‑order products are non‑cancellable once we place the factory order, except as required by law.
8.4 Return Condition & Process

Goods must be in full, original cartons and resaleable condition.

Repack securely on a pallet to prevent movement; photograph before and after wrapping.

Use standard haulage (not express or specialist) unless we agree in writing.

Refunds are processed within 3–5 working days of receipt and inspection; please allow up to 30 days in peak periods.
9. E‑Vouchers & Promotions
9.1 One code per transaction. Codes cannot be combined, applied post‑purchase, or used against pallet deals/job lots. Delivery vouchers apply to standard (two‑day) delivery only. Our Price Promise cannot be used with any other offer.
10. Force Majeure
We are not liable for failure or delay caused by events beyond our reasonable control, including (without limitation) acts of God, flood, adverse weather, fire, explosion, war, terrorism, civil unrest, strikes, lock‑outs, industrial action, raw‑material or fuel shortages, power failure, vehicle or machinery breakdown, roadworks, traffic or transport network disruption, or import/export restrictions.
11. Checks Prior to Fixing
11.1 It is your (and your installer’s) responsibility to check Goods for quality, colour, shade and gauge before installation. No claims are accepted once materials are fixed. Installation should follow relevant British Standards for tile fixing.
12. Data Protection & Privacy
12.1 We process personal data in accordance with applicable UK data protection law (including the UK GDPR and the Data Protection Act 2018, as amended). Our Privacy Policy explains what we collect, how we use it, and your rights.
12.2 By submitting images to us (e.g., project photos), you grant us a non‑exclusive licence to use them in our Customer Projects gallery and in promotional channels (including social media), unless you withdraw consent in writing.
13. Liability
13.1 Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, fraud, or any liability which cannot legally be limited.
13.2 Subject to 13.1, we are not liable for: (a) indirect or consequential loss; (b) loss of profit, business, contracts or goodwill; (c) costs of installation, removal or refitting; or (d) losses caused by improper storage, handling or installation.
13.3 Our total liability for loss or damage arising under or in connection with a Contract shall not exceed the Price of the Goods giving rise to the claim.
14. Governing Law & Jurisdiction
These Terms and any Contract are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction, without prejudice to mandatory consumer rights in your place of residence (where applicable).

Annex A — Practical Delivery Guidance (Non‑contractual)

Pallet deliveries occur Monday–Friday, typically 7:00–18:00.

Kerbside only; drivers cannot enter your property.

Ensure clear, level access and someone available to receive.

Inspect on arrival; note visible damage on the driver’s ticket and photograph.

Store boxes vertically, off the ground, in a dry, level area.
